1. Overview

This Refund Policy sets out the terms governing free access, trial access, subscription payments, cancellations, and refund requests in relation to Avya ChatBot, CropLens, and any related services provided by Avya Technologies.

By accessing, subscribing to, or using any paid features of these services, you agree to be bound by this Refund Policy.

2. Free Access and Free Versions

Certain services offered by Avya Technologies may include a free version or limited-access plan with restricted functionality.

As no payment is required for such access, no refund, credit, or reimbursement shall apply to any free version or free-access feature.

3. Trial Access

Avya Technologies may, from time to time, offer free trial access for selected services. This may include, without limitation:

  • a 7-day free trial for Avya ChatBot in a sandbox or evaluation environment; and/or
  • a 30-day free trial for CropLens Pro or selected premium features.

Free trial access is provided solely for evaluation purposes unless otherwise expressly stated.

As no fee is charged for the trial period, no refund, credit, or compensation shall apply in relation to any free trial access.

4. Paid Subscriptions and Billing

Where a user subscribes to a paid plan, Pro version, or other recurring service, subscription fees shall be charged on a monthly recurring basis, commencing on the applicable subscription start date, unless otherwise agreed in writing.

All fees are payable in advance for the relevant billing period.

5. No Refunds for Active Billing Periods

Unless otherwise required by applicable law or expressly approved in writing by Avya Technologies:

  • all payments made for an active billing period are non-refundable;
  • no refund shall be provided for partial use, non-use, or unused time within the current billing period; and
  • cancellation during an active billing period shall not entitle the user to a full or partial refund for that period.

Where a subscription is cancelled during an active paid billing period, access to paid features may continue until the end of that billing period, unless otherwise suspended or terminated in accordance with applicable terms.

6. Cancellation of Subscription

Users may cancel their subscription at any time in order to prevent future recurring charges.

Unless otherwise specified, cancellation shall take effect from the next billing cycle. Cancelling a subscription does not affect charges already incurred and does not entitle the user to any refund for the current billing period.

7. Incorrect, Duplicate, or Unauthorized Charges

If a user believes that they have been charged incorrectly, charged more than once, or subjected to an unauthorized payment, they must contact Avya Technologies promptly and provide all relevant billing details.

Avya Technologies will review such requests and may, at its sole discretion or where required by law, issue a correction, credit, or refund as appropriate.

8. Third-Party Payment Processors

Payments may be processed through third-party payment gateway providers, financial institutions, card issuers, or other payment service providers.

Refund timelines, reversals, processing delays, and payment method restrictions may be subject to the policies and procedures of those third parties.

Avya Technologies shall not be liable for delays or processing issues caused by any third-party payment processor, bank, card issuer, or financial institution.

9. Suspension or Termination

Where access to any service is suspended, restricted, or terminated due to:

  • breach of the applicable Terms and Conditions;
  • misuse of the platform or application;
  • unlawful, fraudulent, or prohibited activity; or
  • non-payment,

the user shall not be entitled to any refund unless such refund is required by applicable law.

10. Exceptional Refunds

Any refund granted outside the scope of this Refund Policy shall be made strictly at the sole discretion of Avya Technologies.

Any such exception shall be considered case-specific and shall not create any obligation, precedent, or continuing right to receive a similar refund in the future.

11. Changes to This Refund Policy

Avya Technologies reserves the right to amend, update, or revise this Refund Policy at any time in order to reflect changes in services, pricing, billing practices, legal obligations, or operational requirements.

Any revised version will be published with an updated effective date. Continued use of Avya ChatBot, CropLens, or any related paid service following the publication of an updated Refund Policy shall constitute acceptance of the revised Policy.
